Family Application - What should I do?

Post by Bash70 » Wed Nov 30, 2016 7:10 pm

Hi All,
I am confused on what needs to be done regarding my family status. I became a British Citizen in Nov.2015 through TIER1 (General) Migrant route. My family joined me in Nov.2012 and had a renewal that ends early January next year and by then they would have been in the country for 4years 3months. I know categorically that my wife has to renew to make 5years (please correct me if I wrong), but I'm not sure what to apply for my kids. Called the HO and was told I can't apply for ILR for the kids (under 18) and can't do Citizenship. Is this correct?. Are there any options? The impression I got from HO is that they all have to apply for extension to make up for the remaining 9months which cost £9,375 and will have to pay the same amount the following year for the ILR. Paying £20,000 within 12 calendar month is incredible

Need help please

If your dependents APPLIED for the visas after 9th July 2012, then yes, they ALL need 5 years residence to qualify for ILR.

Children will follow the same path as your wife, so yes, they will ALL need an extension and pay the visa fees and the immigration health surcharge each.

Children born abroad are expected to hold ILR before they can apply for citizenship.

Remember that ALL fees are increased in March/April every year so likely the ILR fee will be more than the current £1875 (Postal) or £2375 (premium) fees.

Its always a case of weighing up costs versus benefits (that's benefits with small-b).

Of course, to add to my response already and noajthan's response, your dependents don't have to apply for ILR as soon as they reach 5 years. Their PBS Dependent visa extension will be for 3 years, so you can plan finances accordingly.

Thanks all for quick response. @CR001, the issue now is that on the HO website, the ILR will be closed to TIER1 status in April 2018 which leaves no room to plan finances as you advised

Closed only for main Tier 1 G visa holders NOT dependents.
