HI,
I applied for a Tier 2 General VISA at Chennai India on 18/11/16. I applied for a job role which is under shortage occupation list 2126- Product design Engineer.
I received an email from British high commission today asking me to attend for an interview and submit the evidence of Resident Labour Market Test completion on Monday 5/12/16.
The job is under shortage occupation list and RLMT was not performed. This is mentioned in the COS and my legal representatives letter.
Why would they still need the RLMT? And what kind of more evidence i provide them?
I applied for a Tier 2 Gen 6 months back(unknowing the cool off period) for the same job and employer and VISA was refused stating the the ECO cannot contact my employer through phone and confirm the job.
Could that be a reason that i still apply for the same job after 6 months and so they need the RLMT? But as per the UK VISA rules, shortage occupation doesnt need a RLMT? I am confused.
I was working for the same employer since Mar 2011 till Oct 2015. I left UK in Nov for personal reasons to India.
Can someone please advise what should i provide in this case?

You appear to be pre-selected for the company if not the job.
That's probably why a chit chat has been arranged in order to untangle the story and get to the bottom of it all.

I work for the company at its Indian branch in Bangalore since April 2015. Since then didnt find anyone suitable for the role yet and i already worked for the same team for 5 years, my employer finds me apt for the role. As it is in the shortage occupation list, we didnt do a RLMT? How do i prove that my emplyer didnt find anyone suitable?

Why would pre-selection be an issue if it's a job on the shortage occupation list?
It's exempt from having to be advertised to the settled workforce.
How is there a pre-selection? Pre-what?

Hi,
I had the interview yesterday and it went fairly well with the questions on the job i will be going to take up.
I had 2 refusals in the past for the same employer. A Tier 2 and a business VISA refusal.
The interviewer was asking how i knew about this job and what happened next? I told i applied for a Tier 2 and it was refused and he asked the reason for it.
Then he asked "what happened next"?
Then i explained that i am working for the same employer since then and the vacancy is still open so i am reapplying for a Tier 2. I actually missed to mention about the business VISA refusal which happened after tat, the business VISA refusal was for my Indian job and not related to the current job i will be applying. It was not intentional i missed it. With spur of a moment i thought he is interested only in the new and i didnt not mention it i think. As soon i as i left the room i realised i should have mentioned it.
But in my application i have addressed both my refusals and in my Legal representatives submissions.
Is this going to be a problem? Will it make them think that i have hidden this from them?
Experts please help me.

I'm afraid no one here can possibly know whether it would be a problem.
Previous applications, successful or not, are not usually taken into consideration and a new application would be taken on its own merits.
However, no one here knows the entire story, so won't know 100%.
