Marry again

Hi all,
Please can i be able to marry again to my non eea partner with the PR i acquired through my formal marriage to an eea national after divorce?

You cannot sponsor a new wife under the EEA/EU route. You will have to follow the UK immigration route for a spouse settlement visa and meet all the requirements.

After having acquired PR in your own right, your immigration status is independent of your former EEA spouse and hence provided you are free to marry (i.e. after the decree absolute), you can marry another partner without affecting your immigration status.

However, as CR001 has pointed out, your EEA spouse will need to be sponsored by you under the much tougher and far more expensive (each application costing about £1000 currently, as opposed to £65 under the EEA Regulations) UK Immigration Rules. S/he will need to apply for a family of a settled person visa and renew it in 2.5 years time, before applying for ILR (as opposed to acquiring PR automatically. ILR costs about £1875 currently and will be much more expensive in 5 years time). There are salary and language requirements to be met, etc.

Any children born to you in the UK will be British citizens by birth. Children born aboard will have the status of the less-privileged parent and will not automatically be British.

1) If in UK you can marry if you apply via Registrar and are granted permission.

2/3) Spouse may be able to apply for a spouse visa if you meet requirements. Check Gov UK website.

4) Go where?

Just to clarify, were you married to the non-eea baby's father before your marriage to the EEA national? If so, did you divorce him before the marriage to the EEA National? A timeline may help.

Do you work? And if so, how much do you earn? Do you meet the salary requirement of £18,600 per year to sponsor a non-EEA spouse? Does your non-EEA partner meet the language requirements for sponsorship?

When and how often does the non-EEA father have contact with his child? When and how did the child acquire British citizenship?
