Tier 2 General - change of employer, notice and curtailment

Post by mdec13m » Sun Dec 04, 2016 12:47 pm

Hi all,

I have tried searching for information on the forum on this, but was unsuccessful.

I am currently on Tier 2 (General) visa, and I would like to change my employment. I am currently looking for jobs, and my plan is to find a job first and secure the CoS, before I resign from my current employer.

I am interested in understanding the timelines for this process. My notice period with my current employer is 3 months. This would mean that in agreement with my new employer, start date on my new Tier 2 visa will be 3 months after I resign?

Also, in case I resign before I find a new sponsor (I will endeavor not to do this, but my situation is becoming unbearable), and my current employer notifies UKVI within 10 days, will UKVI consider my notice period (3 months) and then add another 60 days for visa curtailment? Or will it simply ignore my employers notice period and impose 60 days straight away. The difference is quite big (5 months if it's former compared to 2.5 - 3 months for the latter).

Many thanks for hosting this forum, it is an absolute information gold mine.

Your current employer only has to notify HO once you have left their employment. The 60 day curtailment letter has no relevance to your notice period. Curtailment letters can take a while to be sent out.

You should secure a new visa before resigning. A CoS is no guarantee that a visa will be granted.

Excellent, thank you very much for the prompt reply.

Yes, this is ideal, but very hard to commit to a start date (or persuading employers to wait for months :) ).

Thanks a lot once again.
