Switching from T2 ICT to T2 General Dependent

Post by needshelp » Sun Dec 04, 2016 3:56 pm

Hello Everyone,

I am in the UK with the following Visa.
ICT TIER 2 LONG TERM STAFF MIGRANT VISA
(For 3 years + 2 years Extension)

I am planning to get married soon with my partner expecting to have a Tier 2 General Visa in the UK.

I have 3 questions -

1. Can I apply for a Tier 2 General Dependent Visa without the cooling off period once my current ICT visa expires? And from where? (Application from Home Country or UK?)

2. Is CoS required in this case for me? And can I continue working with the same employer?

3. After 1 or 2 years, can I apply again for a Tier 2 General Visa without the cooling off period? (End result being I never serve the cooling off period at all!)

Thank you for being an amazing and helpful group. I look forward to a response :)
Many Thanks in advance :)

No cooling off period if apply as PBS Dependent. You can apply WITHIN the UK once your partner has Tier 2 G and is in the UK.
2. Is CoS required in this case for me? And can I continue working with the same employer?
No and yes but that would be up to your employer. You will have to notify them of your change in visa status.
3. After 1 or 2 years, can I apply again for a Tier 2 General Visa without the cooling off period? (End result being I never serve the cooling off period at all!)
You can apply for your own Tier 2 General visa once you have held a PBS Dependent visa for a full 12 months (cooling off period). You have to apply for Tier 2 General from your home country and sponsor will have to complete the full and proper RLMT process.
