Aged Mother's immigration options

Aged Mother's immigration options

Hi,
My mother is over 70 years old and currently with a green card with my Sister in USA with Indian passport. Both me and my mother would like her to migrate to the UK and live with me. I have recently acquired British citizenship. We are four siblings and all live outside India (2 in UK and 1 USA citizen other USA H1-B).
Do I have an option for her immigration to the UK ? If so what is the best route (visa category) for me to apply for her ?

Hi

You should look into Surinder Singh route. ie find a job some where in the EU and then ask your mother to join you over there and apply for an EEA family permit. One caveat is that since Brexit you might not have enough time. Others might be able to shine some light on this.

Search Surinder Singh route on this forum and google and you will find plenty of links.

I wouldnt bother with the UK Home office as the law is pitted against you. You will end up wasting thousands of pounds and endless HO objections will make you wish you were never born.

Very few options.
UK migration policy appears to be centred around a very tight definition of nuclear family (rather than extended family);
it does not subscribe to any form of chain migration or petitioning for relatives to join them.

Not likely to be fair to drag an aged parent all round Europe and into an alien culture.
And OP would have to shut up any UK home, business and ship their whole nuclear family off to a.n.other EU memberstate.

OP would then have the complication of dealing with HO in relation to both Surinder Singh and then entry into UK and finally settlement in UK. So 3 cycles of dealings not just one.
As you have discovered in your own travails with HO even the latter is not straightforward (even when aged parent has already made it to UK).

Furthermore, its not as simple as taking a European vacation for several months or a year or so.
An AP with US greencard and close relatives in US is unlikely to be able to demonstrate and prove their financial dependency on a UK-based relative for their essential daily needs.

And you may not have got the memo but, in the prevailing hyper-politicised climate for migrants, UK gov and HO clearly have Surinder Singh in their sights;
further changes to the UK flavour of Surinder Singh were introduced only this month.

In short, obtaining a FP for an AP is, based on recent members' experiences, highly problematic.

To understand the hard truth of how difficult (if not impossible) it would be to sponsor your mother's settlement visa, this article by Freemovement explains the situation clearly.

You should also be aware that if your mother applies for an Adult Dependent visa and is refused, the door will be firmly closed for entering the UK as a visitor in the future.

From all the replies so far... It looks like it is almost next to impossible :( ... Only other thing i can think of is earn many millions and get an invitation to settle for the investment i make. Sadly The latter option looks more likely than the former one. Thanks for your inputs folks.

Unfortunately, this doesn't happen either. Settlement has to be earned with residency which has to qualify under the immigration rules.
