Tier 2 PBS Dependent to Tier General Main Applicant

Post by monushh » Tue Dec 06, 2016 1:56 pm

This query is about my wife who is currently in UK under Tier 2 PBS dependent under my visa (I am the Tier 2 General main visa holder).
I am currently on Tier 2 General visa since March 2014. Myself and my wife we both received entry of clearances together and both our visas are valid up until March 2017.
My wife has been currently offered a permanent post at one of the NHS hospitals those who are happy to sponsor her Tier 2 General visa.
Therefore, below are my queries which I would request you experts to kindly clarify:
• Will her transfer from Tier 2 PBS dependent to Tier 2 General Main applicant would count as Switching or will it be considered as a new application all together?
• Will there be any cooling off period applicable to her?
• Can she apply from Tier 2 PBS dependent visa to Tier 2 General visa within the UK?
• How long the process usually take?
• What are the costs for her application?
• When successful, can I transfer myself into her visa as dependent, within or outside the UK?
• Will my Tier 2 clock for ILR still be counted?
Just to add here, my current employer is happy to extend the visa for me but because we must take care of a toddler and therefore I need to switch myself from Tier-2 General to PBS dependent so that I can relocate myself.
For further information, please do not hesitate to comment.
Your comments will be much appreciated!
Thanks, in advance :) .

• Will there be any cooling off period applicable to her? No, not applicable to PBS Dependents.
• Can she apply from Tier 2 PBS dependent visa to Tier 2 General visa within the UK? No
• How long the process usually take? It varies, few weeks and couple of months
• What are the costs for her application? Depends on length of visa. https://www.gov.uk/tier-2-general/overview
• When successful, can I transfer myself into her visa as dependent, within or outside the UK? Yes
• Will my Tier 2 clock for ILR still be counted? Yes, both of you will get reset to a new 5 year route.
