UK Spouse Visa - Absence of 14 months and now returning

Post by ravibabu1408 » Thu Dec 08, 2016 12:31 pm

Hi There,

Could you please clarify below query regarding My wife's travel from india.

My wife's dependent VISA was approved on April 2015 and she came to UK in May 2015 and stayed in UK for 5 months. Then she went india for Maternity Assistance in Nov 2015. Now My wife is in India more than 14 months. Now I am planing to bring my wife to UK. Does my wife need to produce any medical certificate during immigration in UK?.

Please advice on this.

Regards,
Ravi

No, but she must enter the UK with a valid visa. No harm in carrying documents about absence in case IO questions her.

Would "Maternity Assistance" be considered a valid reason for an absence of 14 months at the time of applying for ILR or would the spouse have to go for a further dependent visa (in addition to the one in January 2018) before applying for ILR?
I am not a lawyer or immigration advisor. My statements/comments do not constitute legal advice. E&OE. Please do not PM me for advice.

There is no absence limit for spouse visa but absence should be limited and for good reason. Any and all absences of 6 months or more have to be declared for ILR. Subsisting marriage and evidence of communication will also have to be provided.
