Nominating a guardian (who lives abroad) to British children

Post by errante » Thu Dec 15, 2016 12:04 pm

Hello everyone

My husband and I (both British nationals) would like to nominate a relative of mine as a guardian to our kids, should the worst happen to both of us, however, my relative lives abroad. Does anyone know if a) we would be allowed to nominate a foreign national as a guardian being as they've never been to the UK before or have any other ties to the country and b) what kind of procedure would my relative need to follow to enter the country and take charge of the kids in the worse case scenario, please?

Also, if anyone knows how to actually start the legal process to make this decision official, please kindly let me know.

Many thanks,

errante

a) Not an immigration related question. You are free to choose whoever you wish.

b) Depends on a number of things and what rules are in place by HO at that time.

c) Suggest contact a legal person who deals in family issues for advice on how to do a nomination etc. Most people just stipulate it in their last will and testament.

b) Noone will have an automatic right to enter country just because they are a guardian.
