Child travel awaiting naturalisation

Post by grantcallaway » Mon Dec 19, 2016 1:48 pm

Hi guys,

My daughter was born in England before my wife and I had ILR. That meant that when we travelled, she had to get a dependancy visa in order to re-enter the UK with us.

Since then, my wife and I have obtained ILR. We did not get ILR for my daughter, since our ILR qualifies her for citizenship/naturalisation.

My question is - if we submit her application for naturalisation, and want to travel abroad in the meantime, will my daughter (3 yrs old) be refused re-entry, since she does not have a valid BRP, even though she is entitled to (and has applied for) naturalisation?

Daughter is not eligible for naturalisation; she is entitled to register as a citizen.
She will not be British until registration is confirmed so she can't enter UK on the strength of a pending application.

Thanks Noajthan - thats what I thought.

Any options available to her that would allow her to travel in about a month? Obviously she can leave without hassle - but being technically South African, would there be any kind of visa that would allow her to return (other than ILR which will take longer than the citizenship registration)?

No, not really. She is clearly not a visitor either so wouldn't qualify for that.

When did her visa expire?

When did you get ILR?

I got ILR last year.

I was going to apply for her citizenship immediately after, but had budget issues.
I now plan to apply for my own naturalisation, and my daughters citizenship this month (through different channles)

When did the child's visa expire??

Unless you apply for a settlement visa (expensive option) I would suggest postpone your travel.
