tier1 enterpreneur ext to ilr urgent help please

hi guys ,
kindly I need urgent help please. my tier 1 entrepreneur extention is in process while my 10 years is completing in the mean time in January ,some how I have booked an appointment by the end of this month because I thought I can apply within the 28 days now the problem is my solicitor is saying you can not apply with in 28 days period as your leave has been expired .the 28 days rule apply only for those who have already valid visa remaining kindly can you please advise me best of your knowledge.i humble request to cr001 and zimba88 please reply me I have very short time to go further a head or change the date.thanks

Your 'solicitor' is wrong. You can apply for ILR LR anytime WITHIN 28 days of reaching the 10 year residence mark counted from the date you ENTERED the UK.
