Hello
I’m in the UK for past 3 & ½ years now and hoping to get some clarity on what could be the best step under my circumstances
Kindly guide me
Visa- 3years
Type : Tier 2 (General) Migrant
Issued : 16/07/2013
Arrived : 27/07/2013
Valid until : 30/07/2016
Salary : 28k per annum
Visa extension- 2years
Type : Tier 2 (General) Leave to remain
Issued : 02/08/2016
Arrived : in the Country (UK )
Valid until : 15/09/2018
Salary : 29k per annum
1. I've UK residents telling me ( along with my sponsor/employer ) that I am not eligible for ILR and PR as there has been some rule change in 2011 and implemented in 2013( 1st half of the year ). To my best knowledge I searched and read eligibility criteria online which adds me in ( except salary ). Kindly suggest if I am eligible for ILR after the required time ( 4.5 + years )
2. My employer is likely not to increase my salary, if this is the only requirement that I’m lagging for ILR, is there any other possibility to fill it? (Changing sponsor will reset my clock to 5yrs for ILR )
3. Is it wise to apply dependent Tier 2 General visa before I complete my 2years of Tier 2 General ( as I have personal obligations). Please let me know if you need my spouse Visa details
4. I have also learnt that from 2018 ILR or PR eligibility is going be 10 years is that true ? if so am i effected by that ( being 2013 Tier 2 applicant ) ?

You are being very ill informed.

Recent ILR applicants informed me that whole 5th year need to be 35k salary ( before ILR application ), 12 months of payslip reflecting the same.
Does it have to be only my salary ? or can I add my spouse’s salary as a family income, which sums definitely beyond 35k pa?
When they were extending my Visa - 3rd party Migration consultant said there won’t be any need of 35k salary criteria for ILR/PR as long as I get a letter from my sponsor/employer after 5th year completion ( although she didn’t mention what was content of the letter )
Kindly confirm if that’s another baseless story.

You must be earning £35K a year at the time when you apply for ILR. You will have to demonstrate that by submitting your latest salary slip, corroborated by your latest bank statement showing a matching transaction. A letter from your employer cannot be used to bypass this requirement. The £35K salary rule is based on personal income, therefore, your overall family income will not satisfy the requirement.
If your employer is unable/unwilling to increase your pay to the correct level, you should try and find a different sponsor. Switching jobs will not reset your residency clock.
