British Citizenship – A Few Questions

Post by mause2003 » Wed Jan 04, 2017 12:51 pm

hi all. I would like to ask:
1) I m on Iva, should I mention this on application for citizenship? I see only question about be bankrupt, another thing is they doing credit check? my credit history is poor, I paying my dept regulary on IVA, nearly one year behind me. 4 years left.
2)another question who can confirm referee? I m self employed single mom, working 20h per week, few my clients have office a home, some types od ltd i think businesses, on the farms. i cleaning houses, are they right persons to confirm me?
I dont want lose 1500£ for application and be refused so need to ask everything, I have permanent resident blue book, received a month ago.
3) I m pregnant with donor baby from sweden, co-parenting, my maternity from job centre starting in the next 2-3 months, will I lose status of worker and be refused for citizenship while on maternity allowance from job centre? i mean public funds? like I said self emoloyed, no contract with employer, should I apply before I will go on maternity allowance?
thanks

Please refrain from starting multiple topics. I have merged yours.

An IVA is registered on the Insolvency Register as is only one down from bankruptcy. HO do check the insolvency register for citizenship applications.

I ve seen the link. but its still not clear about Iva. on forum I can read:

An IVA is a formal agreements between you and your creditors and it is not a civil judgement. And in form there is no question relating to IVA but there is question about civil judgement. Someone could have credit card debt 150 pounds and creditor can take the person in court and court will issue a ccj if you dont pay within a month of ccj. And here is my point. A person cant register an iva if debt is less than 15k. And second thing is iva and ccj both open viewable to public. So yes mentioned it page no 13 and attached necessary documents. A ccj seems to be worse than iva. But check your all address in last 6 years so it will help you whether you had any ccj or not. If not then great. But a ccj doesnt indicates insolvency even though it is very bad but iva indicates part of insolvency. To be honest iva or ccj as long as you try to pay debt HO will approved it as long as it is store card or credit card debt but if it is for council tax or unpaid house rent or hmrc tax then it will be complex. I think you wont have any problem to get brit citizenship.

and also i see:
As CR001 has already advised, both IVA & bankruptcy are very likely to adversely affect your BC application. Even more so with the high level of debt.

and:If you have an IVA then your name is under insolvency registered. And if its on the process still i think your debt is 15k+ or much more. An iva should not be an issue to refuse your application.

and:
Q18 - I have an IVA will this lead to a refusal?

Providing you are making repayments this should not indicate that you are deliberately and recklessly building up debts with no intention of paying them back and should not cause a refusal.

so its realy confused information for me

Caseworker discretion based on HO guidance (linked) is what will determine your case.

I don't know enough about you to form an opinion on your good character and the rest of your application.
The caseworker will do that.

For example, if you have a history of financial recklessness and irresponsibility with a trail of debts then, as per guidance, it does not look good.

If you have an isolated case of a financial mishap and have handled it proactively and responsibly in a disciplined way then that will go in your favour.

NCS are just an agent and take no part in the decision-making process; that is the HO and caseworker's job.

If an application is submitted and later fails you will lose the fee.
