ILR for dependant

Post by abhi2016 » Sat Jan 07, 2017 3:14 pm

Hi,
I am on Tier (2) general Visa, and I will be eligible to apply for ILR in November 2017.My question is if my wife is eligible to apply for ILR with me in November this year. Her situation is detailed below

She first came to UK in May 2012 as PBS dependent (Tier 1 general post study work visa dependent)
She switched to Tier (2) general dependent visa in November 2012
She went to India in April 2013, and came back to UK in April 2014
She extended her Tier (2) general dependent visa in November 2015

Is she eligible under the 2 year route mentioned in the Gov website (copied below)

2 years - for applicants granted leave as the partner of a PBS migrant under the
rules in place before 9 July 2012 and who have since had continuous leave in that
category

Yes, provided she did not let her visa expire while out of the UK and had to apply for a new entry clearance to come back.

Many thanks for your reply.
She has never let her visa expire while she was outside UK
