Non eea family member permanent residence Application

Hi Everyone

I need you advice. I am from cap verde and my husband is french
i have a 5 year residence card in the UK which will expire in April 28th 2017
I am working and want to apply early for the permanent residence by the end of January
My question is : is it possible to apply early for a permanent residence before the expiration
date of my residence card.

You have to have a full 5 year period of residence in the UK. There is no option to apply early.

Has your husband been a qualified person exercising treaty rights for the full 5 years in the UK,?

Hi,

Its all depends on when you entered in to UK not based on when HO issued residence card.

Hi everyone

thank you for your feedbacks , yes my husband has been a qualified person for the 5 years
I came in the UK in 2011 with a visa and after 6 months applied for the 5 years non EEA family member residence card which I got and started in in April 2012. In April 2017 the residence card will expire
but base on what you said I used 2011 my year of entry to estimate my full 5 year ?

It's based on when you were married and in the UK and was your spouse exercising treaty rights at the time?

When i came in the UK in 2011 my husband and I were already married so I supposed based on your feedbacks that I should consider 2011 as my started point for the 5 years period ?

I saw the link of vinny . Thank you all of you this is really helpful

So based on my marriage and date of entry my five years was in july of last year
so do you think they will be a problem if i apply 7 months after that ?
and also For the application i will send my husband passport but
his passport will expire in march 2017 when it is wth the home office . do you think it will be a problem
or it is better for us that he does his new passport before we send everything.

The confirmation of PR is optional (although useful) so you can apply at any time from now onwards as you probably acquired PR last year.

if sponsor's passport is valid when application is submitted it should be acceptable.
Or he may choose to renew it before you apply if that works out better for him
