Is there a chance to win JR against Citizenship refusal

Post by Homygoodman » Mon Jan 09, 2017 2:01 pm

Dear All,
Case Summary: Applied asylum 2001, refused 2007, appealed, JR Launched 2008, mach 2009 ID Card changed from Employment Permitted to Employment Prohibited. The same day I emailed my manager n resigned from my job (I have that email). March 2009: requested to cancel asylum, Home Office did not reply. January 2010 Removed from UK. Febraury 2010: Home Office sent a letter acknowledging they lost my passport. May 2012 came to UK with Spouse Visa. Sep 2014 got ILR. October 2015 applied for naturalisation. March 2016: Citizenship refused because I was working 2007-2010 with my asylum refused (although I had Employment Permitted ID, was doing monthly reporting, paying tax and the Home Office have the name n address of my employer). Reconsideration sent April 2016. December 2016: Reconsideration refused for same reason, also HO claimed they sent me an IS 96 paper in 2008 that I am not allowed to work, which I never recieved.

The Home Office surely did not inform me that I am not allowed to work from 2007-2009 n the ID Employment Permitted Card proves that. Although my asylum case was refused, I was still appealing n doing my monthly reporting to the Home Office. When the Home Office gave me the Employment Prohibited Card, I resigned from My Job n decided to leave because no body can live in London without working, but the Home Office couldnt let me leave in a civilised way because they lost my passport.

I am thinking to apply for Judicial review n I have to decide within one week. Knowing that naturalisation is a grant n not a right, is there a chance to win?. Any one knows any naturalisation Judicial Review Cases that won?
Thx a lot for sharing ur knowledge

No, generally people just wait for the time to pass until they can apply again.

JR is very expensive, which is why most avoid it.

Hi

I think it might cost around 3500£ n takes about 6 months to 1 year. Before I decide I am balancing how realistic r the winning chances, if there is no realistic chance, it might be better to leave it

Reconsideration costs £200-£300 and takes around or up to a year or so.

Hi,
the reconsideration took 8 months n was rejected.
I am thinking is there a realistic chance of winning a judicial review or not
Thx

Also does anyone knows any good Barrister who have experience in handling tough Judicial Review naturalisation cases?

If the IS96 was not served on you, and you immediately ceas ed work when the new ID prohibiting employment, then it will follow that the refusal was flawed and you will be entitled to relief upon Judicial review, if you can prove what you say.

The burden will be on the Home Office to demonstrate that the IS96 was served on you, that you received it, and continued to work in breach of its conditions.
