You need to apply for a visa extension. It is not just applying for a new BRP card.

If you are on a spouse visa, you must apply on form FLR(M). The fee is £811 for postal and £1311 for in person same day decision. You also have to pay the £500 immigration health surcharge before you can apply.

You need English A1 test again and you must meet the financial requirements again.

You can apply up to 28 days before your visa expires.

On what date did you arrive in the UK?

I arrived in UK Feb 2014 on Tier 2 visa. I married British citizenship since 2008 but we lived outside of UK.
I applied for FLR(M) right after I arrived in UK and received BRP in August 2014. The BRP card will expire in 23 February 2017.

I am going to apply on FLR(M) by end of January.

So what is your question then if you are applying for an extension in January?

Surely you can do this basic calculation :?:

It does not have to be on exactly the 28th day, it can be any day WITHIN 28 days before visa expires. I don't know what the appointment availability is if you are applying in person, you will have to log into HO website and see.

If applying by post, it makes no difference as your new visa will be issued from date of decision anyway.

I suggest that you count back 28 days from the expiry date on a calendar.

I have other question regarding financial requirement.

I am currently on LOA ( leave of absence for one year, no salary will pay) it was started on 14 November 2016.
Previously I was on other type of leave ( which was started in November 2015 for one year), they didn't pay me monthly. I receive payment on November 2016 ( £18,900 before tax) after this contract expired.

What category A or B should I use if I want to meet employment financial requirement?

I thought you are on a Spouse visa? Are you now posting as the sponsor of your spouse? :?

What is the annual income of the sponsor :?:

I am on a spouse visa and also employed in UK. I want to use my income to meet financial requirement. Need to know if I can use employment income and under which category?

If not. I have enough cash in a bank in combination with my sponsor income to meet financial requirement.

Your income doesn't qualify as you are on unpaid leave. In order for earnings to be considered a letter must be submitted from the employer confirming that the employment is ongoing.

What does your sponsor earn p.a and what level of savings have you held in an accessible bank account for at least 6 months?
