British Passport application for son - Father is on ILR

Post by NidaA » Thu Jan 12, 2017 6:42 am

My husband has an ILR and we are living in Pakistan currently. My 1st son was born in the UK and has a british passport. I want to apply for a british passport for my 2nd son now who is born in Pakistan. What is the best way to go about it? Would we need to move back to the Uk for it? how long does it take? Can it be done through post here in Pakistan?
TIA

Not possible, if neither parent is British.

How long has your husband been out of the UK since getting ILR?

We have been out for almost 4 years now. But he keeps going to UK for work etc every 6 months. So far he has had no objection on his ILR on entry.

My first son got his passport based on Husbands ILR. We were living in the UK at that time though and he was born there

Vinny was referring to your second son's eligibility for citizenship as son was born abroad. Children born in the UK to parents holding ILR are automatically British or if born before parent(s) got ILR, they have an entitlement to register as BC. Your son born abroad does not have any entitlement.

You should note that ILR is not maintained by short or frequent visits. If you have not been back to the UK for 4 years, you have likely lost your status and will have to start from scratch again.
