Tier 2 English language requirement

Hi,

I am outside U.K. And I have been just refused a Tier2 visa due to lack of evidence of English language requirement. I have been granted previous leave to remain under tier 2 in2013 2014 an in 2015, but at that time I was in uk. In 2013 I had a valid IELTS. This time I claimed points on basis of my previous grant of leave, as outlined in visa guidance.

point 159 states "You will be awarded 10 points for English Language where you have met the English Language requirement in a previous grant of leave. This will be case if you have ever been granted leave : under Tier 2 general category under rules in place on or after April 2011 having provided evidence of having a knowledge of English equivalent to Level B1"

Am I right in my understanding, that I fulfill English language requirement based on previous grant of leave, and should I go in administrative review.

Yes the policy has changed from last April. I think If you have T2 before, it should be OK. Do you have validate T2 now and apply to extend or switch of employer?

Clearly outside the UK, applying for a new entry clearance visa after the 12 month cooling off period.

No at present I don't hold a tier2visa. I am applying for a new entry clearance after a gap of one year. So does this rule apply on me for a new entry clearance.
