HELP!! with FLR(m) Application form PLEASE!!

Hi

Big thank you first and foremost to this forum as it has been very informative in helping us to complete our application.

Just had a couple of questions for my (non-EEA) wife's application. Our one-day appointment is booked on the 27th Jan 2017. It is for her second period of leave under the 5 year partner route. We opted to do the application ourselves this time as solicitors were giving us ridiculous quotes for what we felt was going to be a simple application.

My first question is about the financial requirement. I am in full time employment earning above the £18,600 threshold required in our case and so I wished to solely rely on my employment salary. My wife is employed part time, she's only been working for the last 6 months after a 20 month career break (for the birth of our child and childcare reasons) - starting on 12 hours then moving onto 30 hours after 3 months. I wasn't actually too bothered about including her employment in the application as I felt it may just complicate matters, however I just wanted to get a second opinion of whether I should or should not.

Second question is regarding section 13A CHILDREN of the FLR(M) form. Our child is a British Citizen with a UK birth certificate and passport. I will be submitting both documents even though I don't think they need the passport, but having read this section in the form, I'm left a bit confused as to whether I need to provide additional Evidence of where our child normally lives dated in the last 3 months??

Would appreciate any advise.

1. You can rely solely on your income to meet the requirements but you must complete the forum honestly and include her employment where it asks for it. You should not withhold any information.

2. You need to mention the child in the relevant section and birth cert is sufficient. You do not need to provide anything else as the child is not applying for a visa.

To clarify, I am required to fill in the fields in the table requesting employment information for my wife (APPLICANT) too even though I'm only relying on my source of income (not an issue)- so does this mean I need to provide supporting evidence (6m payslips, statements etc) for her too?

Yes you must declare her employment.

No you do not have to submit evidence if not relying on her income to meet the requirement.

Thank you sooo much for clearing all that up for us!

Tried asking HO earlier this morning and the lady that picked up kept reiterating to me to read FLRm guidance notes which left me fuming in the end. They usually been pretty good in the past with providing answers to more difficult questions.

Anyways I'll keep you updated with progress after the big day.

The lady in question probably didn't have the answer and the 'help line' staff are notorious for giving incorrect advice. It may well be fortunate that you weren't given an answer. :idea: I believe that the HO service is outsourced to an agency.

I get the feeling you may be correct Casa!! which is very worrying and frustrating. Tried to ask them a question again yesterday about my payslip and they again gave me a "refer to rules" response - even having said that I've gone through them like 20 times and haven't found the answer to my query.

I enquired about my last payslip which is dated 31/12/16, and the amount was paid into my account on 23/12/16 (little earlier than usual because of Christmas). My bank statement showing that payment is dated 12 Dec 16 to 12 Jan 17. Our application date is 27/01/17. Question was whether the 28 day financial evidence rule only apply to the date on the evidence produced, or the date on which I have been paid.

I probably am overthinking this (as with everything else) but just wanted to be sure.

I would include a simple explanation with the application. This must be a frequent occurrence over the Christmas holiday period.
