ILR for my UK born baby

ILR for my UK born baby

Dear All,

I was wondering if somebody could kindly advise me. I have a UK born 4-month old baby and I received my ILR a month ago. I am aware that once I received my ILR under the British Nationality Act my baby is entitled for a British Citizenship registration. The issue I am facing is that I actually do NOT want to register my baby as a British Citizen. I want my baby to have ILR instead, just like myself, because our country doesn't recognise dual citizenship. I have been searching online for any information on whether it is possible to apply for ILR for my baby and so far I am unable to find any reliable information. Could someone please help me with finding answers to:

1) Can a UK born baby whose parents are ILR holders apply for ILR?
2) If yes, then can you please point me to the right direction where I can get information on how to apply, what are the requirements and whether or not we can apply for baby's ILR from UK?

Any assistance is highly appreciated.

Dear CR001,

Thank you for sending the links to the ILR application for children under 18 and the guidance notes.

As my child is born in the UK, she hasn't left the UK yet and she hasn't gotten the passport from her country. She can only apply and receive that passport by physically being there. So my question is: can she apply for ILR while being in UK without her obtaining her passport first from her country?

Ideally, we would have liked her to get her ILR before we travel to our country, if that is at all possible.

The child needs a passport, for ILR and to be able to fly out of the UK. Surely you can apply for a passport from your embassy??

Dear CR001,

Thank you for getting back to me so quickly.

Unfortunately our embassy doesn't issue passports abroad. We will have to go home to get the passport. However, on the basis of the UK birth certificate, they will issue a travel document that allows the baby to travel from UK to our country and to apply for the passport at home. Do you think we can apply for my child's ILR from UK with that travel document? In the application form they require passport, national identity card OR travel document. I am wondering whether the travel document that our embassy issues would enable us to apply for ILR from UK? The travel document has only 1 month validity though. would that still work?

You will need to apply for a child settlement visa (UKVI should issue ILE - indefinite leave to enter).

Thank you once again for providing most invaluable assistance. I read carefully the rules and it looks like our child qualifies for ILR or ILE. My only remain question is: can we apply for my child's ILE or ILR from the UK without passport but with a travel document issued by our embassy that has a 1-month validity?
