One team member inside UK and another outside - Can join?

Hi,

We are two to join as a Entrepreneur team (200k route) - ONE is currently in India, SECOND holding Tier 2 (General) Work Permit visa in UK.

1) What is possibility of these two to join as one team? Tier 2 (General) in-country switching is allowed?
2) Can ONE in India first apply investing the total funds (200K) after getting the visa is it possible to include the SECOND one who is existing in UK already?

Alternatively Investor Visa (200k) route - 2 questions asked above can be executed with this category?

Need clarity please.

It can be done as long as the money is kept in a joint account for 90 days or as required per guide. Switching form the Tier 2 General is allowed.

No, both have to apply at the same time. You cannot join someone with a Tier 1E visa as a team member

Tier 1 Investor visa requires access to at least £2m and you cannot share it with someone.

Need one more advise.

Decided to apply for Tier 1 Entrepreneur visa (200k route). Two Team members (one in UK with Tier 2 visa and another outside).

1)At what stage it is advisable to inform the employer - Tier 2 visa sponsor about resignation and leaving the company.

2) Is it okay to wait until the entire process of T1(E) is over and then resign the job / inform the employer?

To keep your continuous period intact, you get 60 days to apply to switch to another category after your Tier 2 employment ends.
So I suggest to be prepared to apply as soon as you leave your employment or when it terminates.

2) Is it okay to wait until the entire process of T1(E) is over and then resign the job / inform the employer?

Yes, but be aware that if you are granted Tier 1E, you technically lose any right to work for your Tier 2 sponsor on the very same day.
This means you must resign immediately and terminate your employment on that day, otherwise you will be in breach of the conditions of your leave.

It is very difficult situation as if you resign, your visa will be curtailed. If HO take weeks/months to process Tier 1 and they refuse it, you will have no valid visa.

It is paramount that you get your timing 100% right depending on your notice period etc.
