Tier 2- Shortage Occupation Vida renewal

Hi All,

Please can anyone help me with my situation below.

I live with my dependant son and my tier 2 visa expires in May 2017. As for now, I do not meet the experienced Salary threshold( I am on £29000) . I am speaking to my HR to increase it to £30000, awaiting response from them.

1. My query is, in this case, can I make my application before April 6th so that the new rule doesn't imply? E.g.: if this is possible, I am planning to apply in March.
2. I ll be renewing my son's visa alongside and hence I believe i don't have to maintain funds for his dependent visa. Is tat correct?
3. My husband is an Indian working in UAE. Can he apply along with us or should he wait till our visa renews? If yes, can he make an application from UAE despite India being his home country.

3. Does your husband currently have a valid Tier 2 Dependent visa? If yes, then unfortunately he cannot apply to extend if he is not in the UK. Any application from outside the UK is a new entry clearance visa.

You should also bear in mind that the absence requirements for PBS Dep has recently change and any absence of 180 days or more breaks continuity of residence.

He should apply once your extension is granted. He will be issued with a 30 day vignette in his passport and must travel to the UK within this time and within 10 days of arrival, collect his BRP from your nominated Post Office.
