Citizenship Application 5 year or 3 year route

Post by FOR_ILR » Tue Jan 24, 2017 2:14 pm

Hi Gurus,
I got British citizenship in Dec-2014 (route Tier1 5 yrs + 1 yr ILR). My wife and daughter got their ILR last year and will be eligible for naturalization in 2 months time.

Question:
1. Do they have to apply via 3 years or 5 years route?
2. Can we submit Naturalization application 28 days before eligibility ?
3. Can I apply naturalization for my Daughter only without applying citizenship for my wife (she stays in ILR)?
4. If I can apply for my daughter alone, is there any 3 year or 5 year eligibility requirement?
5. During the time application is being considered, can they travel out of country?

Thanks in advance.

Regards,
Kumar

1) Wife has choice of section 6(1) or 6(2) application.
Make sure wife can prove physical presence in UK 5 (/3) years before date of application.

2) No. Its not a visa. No 28-day rule.

3) Minors register instead of naturalising.
Possible.

4) No, but older teens making discretionary section 3(1) application are expected to have spent at least 2 years in UK.

5) Yes.
Allow for enrolling biometrics and to answer any/all follow up enquiries.

--> *Q: Which form? in AN form this section 6(1) or 6(2) is referring to section BRP card details, what i'm trying to understand is whether can I apply my wife's citizenship via 3 year route.

Possible.
--> *Q: Can I submit registration application for my daughter even before 12 months in ILR or do I have to wait for my wife's citizenship application also filed?

Kind Regards,
Kumar

Yes to both your questions. They could have applied as soon as they got their ILR already.

Hi CR001,
Thanks,
1) is there no requirement for my wife to be in ILR minimum for 12 months?
2) as i'm already British citizen, are you saying that "They could have applied as soon as they got their ILR already."

3) Can I then start my daughters application this month itself?

Thanks in advance.

Kumar

Thanks for your help.

based on your response I have now checked application for section spouse is a British citizen:
=========================================================
2. If your spouse is a British citizen

If you’re married to, or the civil partner of, a British citizen, you can apply for citizenship if:

you’re 18 or over
you’re of sound mind, you’re able to think and make decisions for yourself
you’re of good character, for example you don’t have a serious or recent criminal record
you’ve met the knowledge of English and life in the UK requirements
you’ve been granted indefinite leave to stay in the UK (this means there’s no specific date that you have to leave) or permanent residence if you’re an EEA national (and you have a permanent residence card or document that shows you have permanent residence)
you meet the residency requirement

Unless your spouse or civil partner works abroad either for the UK government or for an organisation closely linked to government, you must usually also have:

lived in the UK for at least the 3 years before your application is received
spent no more than 270 days outside the UK in those 3 years
spent no more than 90 days outside the UK in the last 12 months
not broken any immigration laws while in the UK

Hi CR001,

Does this 3 year rule apply from the date I became BC or from the date of Entry of my spouse?
I got BC (naturalization certificate) in NOV-2014 and got my passport in DEC-2014, whereas my wife entered UK in DEC-2013 and is continuously living here from then on.

Thanks,
Kumar

Not sure why you are getting so confused by the 3 year route.

On the date of application for naturalisation, is the spouse of the applicant a British citizen?

If yes, the person can apply immediately after ILR, provided s/he has been resident in the UK for at least three years and meets the absence requirements for the three years (and the other standard requirements for naturalisation).

If no, the person must wait for a year after ILR and must have been resident in the UK for five years, etc.

If your wife entered the UK in December 2013, how did she get ILR so quickly?
