ILR Dependent Application from Inida

ILR Dependent Application from Inida

Dear All,

I have been granted ILR last year and previously my family was on Tier 2. Now they are planning to come here, will i be applying for them as Dependent ILR application?
My wife has got a job here, will that change anything? Can she still apply for as Dependent of ILR, please?

Does she have a current Tier 2 (dep??) visa?

On what basis did you apply for ILR (5 years Tier 2 or 10 years long residence)?

From your previous post, they have a valid visa till October 2017. Why do you want to apply for a settlement visa?

Tier 2 - ILR 10 yrs

Family was in and out of UK on Tier 2 before, so they have been in UK for 3 yrs and Kid was born in UK.

If you got ILR based on 10 years residence, then family must apply for a spouse/child settlement visa.

Your wife having a job in the UK is nor relevant and doesn't change anything. You as the person with ILR must meet the £22,400pa (wife plus 1 child) financial requirement on your own with payslips and bank statements.

Child can be registered as BC.

Wife & Kid, Permanent Settlement from India

Dear All,

I have few questions, if someone can help me through, although have read Home Office documents, but still some doubts.
I got ILR through Tier 2 route after 5 yrs in UK. ILR is until Dec 2024
My wife who has been in and out of UK since last 5 yrs, but the maximum she has lived in UK was 3 yrs. Presently she has been away for 1 yr.
My son was born in UK.
Both were in India on Dependent Tier 2 when they left last year and i got my ILR.

My questions:
1. I am applying for them as Visa type: Settlement
2. Is there a minimum bank balance i have to show in my account, as i only have 3000 Pounds untouched since last 6 months and i would be paying for the visa fees by Credit card?
(My annual salary is 39,600 per year)
3. Will my wife need to give IELTS UKVI? or is she exempt as she has previously been granted Tier 2 dependent which is valid until Sept 2017, she does have a Valid IELTS. However this wont be valid visa for her now, since i was granted ILR last year? Is that correct? Or can she still travel on it and then i can sort her Settlement here in UK?
4.Will i have to fill for each, my wife and kid, a Appendix 2 VAF 4 and Sponsorship Form SU07/12 when i make the settlement visa.

They have a Dependent Tier 2 valid until Oct 2017, can they travel on it, is it valid? Because i am thinking since i was granted ILR until 2024 through Tier 2, doesnt that in some way automatically cancel my families dependent Tier 2 visa validity?
