ILR Eligibility

Post by Vasu2017 » Thu Jan 26, 2017 12:02 pm

Dear Team,

Could you please advise whether I'm I eligible for ILR, find below my details.

First POE --> Feb 2010 - May 2010 (TIER 2 ICT Migrant - stayed in UK 6 weeks; Visa expires in May 29 2010 and applied in July 2010 for second visa).
Second POE --> Aug 2010 - Sep 2011 (TIER 2 ICT Established Staff - stayed in UK 1 month and again came here in Aug 2011).
Later extended here to till date, also advise how to fill the gap having more than 180 days in 2010.

Regards,
Vasu.

What is 'POE'??

What date did you arrive/enter the UK in 2010?

Assuming July 2010 application was a new entry clearance.

Which sub category of ICT did you originally have?

Sorry, will explain clearly.

Find below my visa and period of stay in UK from 2010
----------------------------------------------------------------------
May 2009 - May 2010 (TIER 2 ICT Migrant) --> Stamped on Feb 2009 but travelled on Feb 2010 and stayed in UK for just 6 weeks for short term)
Aug 2010 - Aug 2011 (TIER 2 ICT Established Staff) ---> this visa applied in Aug 2010 after my initial visa expired i.e. May 2010 and travelled in Aug 2010 and stayed in UK for 1 month short term.
Aug 2011 - Aug 2017 (Leave to Remain - Extended here) --> In this period in stayed in UK in each year for more than 180 days .

Hope above information clarifies your query, please let me know if you need any information.

Regards,
Vasu.

You don't qualify for ILR based on 5 years residence as you applied for a new entry clearance visa from home country in 2010.
