Hi, mine is a unique and long case which I have not been able to find any answers for. A little bit of history before I come to my question:
I am an Indian national, married to an EU (French) national. I work in the Oil and Gas sector. We got married in 2009 and applied for an EEA family permit in 2010. Even before I moved to UK I was working with an international Oil and Gas company. After receiving my EEA family permit I moved to the UK and after 6 monthe i got my EEA2 card. All this while i was working out of Norway on a rotation basis. Come 2014 and I was transferred to UK, still working on a rotation and working on my EEA2 resident permit this time.
Second half of 2015, me and my wife decided to move back to India with our child and I would continue commuting from India to the UK for my job. I also adviced my employer at this point that I will be needing a visa from them as my EEA2 would not be valid anymore. My company helped me in applying ICT tier2 visa which was approved and I got it for 3 years from Oct-2015. Now in Feb 2016, I was transferred from UK to India my home country, within the same company. After a few months I received a letter in the post that my ICT visa was cancelled as I was no longer working in the UK.

So, now I have been contacted again by UK management and looks like there might be an opening in the UK office for me. I want to know that now in my case, can I re apply for an ICT visa? If yes, do I have to observe the cooling off period? Last time i entered UK was Jan 2016, although i received the letter from UKBA in May 2016. So, my 1 year colling off period ends in Jan 2017 or May 2017 as per the letter?

Any thought and replies would be much appreciated and if someone can guide me how to go about my application this time. Also, I will be moving to the UK with my EU spouse and EU children, can I also apply for the EEA family permit? The only thing is my wife will not have a job here in the UK and she will move in with me. In this case, if I can show the offer letter and that I have a job, will that be sufficient for an EEA family permit?

Get CSI for all family members and sponsor/spouse will fall into selfsufficient qualified person category and can sponsor you on EU route.
At least for as long as UK is in EU.
Don't spend more than 6 months per 12 months out of UK.

Thanks for the reply. So if I get CSI for all the family members, I can apply for a EEA family permit even though my EU family is living in India with me at the moment? I do not have to show that they are exercising their rights in the UK?

You will only qualify if your family is intending to move back to the UK at the same time as you.
