Tier 2 Extension - VERY Urgent

Hello,

I am currently in the UK on Tier 2 (General), sponsored by my licence-holding employer. My leave runs out on Monday, 13th February and up until this week, i had no intention on renewing my leave.

However, things changed this week wherein I was offered a new position within the same company (same SOC code) and a salary above the minimum requirement as per the Codes of Practice set by the Home Office. I have accepted and would now like my extend my leave to remain in the country.

My problem is that the Authorising Officer set by the company with regard to the licence left some time ago and there was no replacement named. As the expiry of my current leave is upon me, there is no way to have a new Authorising Officer assigned in time who can assign me my Certificate of Sponsorship. When I last applied under this category, my company deployed the services of an agency and upon contacting them this week, they immediately notified the Home Office that the AO is no longer working for the company.

What is the best course of action for me here as I need my application to go in on Monday so I can continue working? Your earliest replies will be very much appreciated.

Your sponsor appears to have a problem of their own regarding their licence. :!:

You must have at least one level 1 user who must be your employee in place
throughout the life of your licence. If we find you have no level 1 user in place
at all, this means you cannot fulfil your sponsor duties and we will take action
against you. We will also take action against you if you have no SMS users in
place at all.


Frontier Mole has the experience to advise on this, but they aren't currently online.

Thanks for your reply Casa. While still not sure, the contact within the agency the sponsor used and has contacted might be set up as a Key Contact and a Level 1 User. Can this person assign me my CoS while a new Authorising Officer is being put in place?
If not, can I contact the Home Office and get a provisional extension so the AO can be set up after which I can put in a formal application?

There are others far better placed to advise on this, but regarding the Agency I would note:
"You must have at least one level 1 user who must be your employee"

There is no such thing as a 'provisional extension'. You have to apply online and you must have a CoS to complete the application.

Thank you Casa, that's helpful. I suppose we will have to use this service to appoint AO then perhaps contact UKVI to request a same day change in light of my circumstances.
