Tier 2 General PBS Dependant Visa to ILR

Post by joselijo » Sat Feb 11, 2017 5:56 pm

Hi,
I had been in the UK for 5 years 7 months and wanted to know if I am eligible to apply for PR? I have been on

1. Tier 2 ICT from July 2011 to Mar 2015
2. Tier 2 General PBS Dependant from Mar 2015 till date

My Tier 2 ICT was applied in Mar 2010 and visa was valid from May 2010 which was extended twice from the UK.

Please advise if I can eligible to apply for ILR?

No, switching to PBS Dependent visa category has reset your clock and you need 5 years as a PBS dependent to qualify for ILR, which will be in 2019. You cannot use a combination of the visas you have held to apply for ILR based on 5 years residence. It can only be combined for 10 years long residence applications.

You would have qualified if you had continued on your ICT visa as it was applied for before the rule changes in April 2010.
