ILR or citizenship for a child whose parents are on ILR

Post by gopalay1 » Sun Feb 12, 2017 1:30 pm

Me and my wife got our ILR in July 2016. We did not apply ILR for our child and he is still on Tierr 1 dependent visa which runs up to Nov 2017. Our child was born in india but has been residing with us for last 4 years in UK.

We are eliglble to apply for British citizenship on July 2017. Can i also apply for my child along with me and my wife directly or should i first get ILR for him before i do it.

If i have to get ILR for my child who is on Tier 1 dependent visa what form should i use and how long does postal application take.

Children born abroad are expected to be 'free from immigration time restrictions', hold ILR, to qualify for citizenship under section 3(1) of the BNA, which is an application at discretion. There have been many BC refusals due to members believing they can skip ILR for a child born abroad and/or save some money.

Apply for ILR using either Set(O) or Set(F), either by post or in person.

Once ILR is granted, child can apply for BC at the same time as you/other parent.
