Help - stay in UK after end of unmarried partnership?

Post by lecross » Tue Feb 14, 2017 12:11 pm

I too need assistance with remaining in the UK if anyone could provide me with some information regarding this i would appreciate it.

I have been living in the UK since Nov 2014 with my Partner of 7 years. We have lived together for 4 years and currently reside in Liverpool. We have recently decide to spend some time apart and due to a family emergency i need to go back to Australia for a few months to assist my family.

between Nov 2014 and Sept 2016 i was on a Youth Mobility Tier 5 Visa and recently in Sept 2016 changed to a FLRM and was granted 30 months on a 5 year route and a Biometrics Card. Should i not reunite with my partner i want to know what my options are in terms of residing in the UK on my own terms. I unfortunately do not qualify for any other visa's but have ready about options like 'retained right of residence' which is usually for married or civil partnerships but have also read cases of this applying to unmarried partners.

Due to the fact that my partner and i have been together 7 years we are classed as Defacto but are not registered. Would anyone be able to provide me with a possible route i could take to ensure my security in the UK on my own terms.

What is your partners nationality? As you applied on FLR(M), I assume partner is British. Partner has an obligation to inform HO on the prescribed form that the relationship is no longer subsisting.

Retained rights of residence does not apply to partner visas under the UK Immigration rules, which is the route you are on.

If you do not qualify for any other visa in your own right, you won't have any legal basis to remain in the UK.

Do you have a UK born grandparent by any chance?

He is British born and has dual citizenship as he lived with me in Australia too.
I do not qualify for the ancestry visa as my British and Irish background goes back more than 2 generations.

Then unless you can qualify for a Tier 4 student visa or Tier 2 General employment visa, there are no other alternatives if you do not have a BC/EU or ILR partner.
