ILR - Tier 2 5 years continuous stay

Post by Shasra » Tue Feb 14, 2017 2:17 pm

Hi,
I am currently on Tier 2 visa. By this year I will complete 5 years in UK under Tier 2 visa. During the year 2012-2013 I went to Istanbul for more than 6 months for Business trip which is part of my job role. During this time employer paid salary into my UK account as usual. Please can you let me know whether my application will be granted if I apply for ILR. I can get letter from employer to support this. I tried to find this specific in website cannot find anywhere and please let me know if you need more information. Please can you help

Many Thanks

Only if you can split the absence into two separate 12 month periods.

How HO calculate is from date you apply (qualify) for ILR, counting backwards.

Put down the exact dates of your absences, and someone can suggest you which date to apply for ilr.

Hi,
I was away from country more than one and half year for business visit. Hence I asking whether my visa will be granted by considering letter from employer. Thank you.

Probably not. 1.5 years is a long absence.

Thank you all for the reply :) Also please can anyone clarify following questions from ILR application page 23 and 28:

Page 23:
6.11 Please give the dates of any absences spent outside of the Crown dependencies (Isle of Man and the Bailiwicks of Jersey and Guernsey) and the UK.
Query: Do I need to list down all the absences spent outside Crown dependencies and UK from the date I entered into UK which is since 7 years?

Page 28:
7.13. How long have you lived in the UK?
Please provide details of any periods of absence of more than six months during that time.
Query 1: I think 6 months absence should calculate by counting back to my application date as per earlier response?
Query 2: Am I right in assuming 6 months absence rule will apply for each year which means 30 months for 5 years?
Query 3: Not sure how do I calculate absence more than six months. I was away from UK for job related reasons more than 180 days in total for each year. This is not continuous which means I lived in UK over weekend and left UK during working days. Does this counted under more than 6 months absence?
