EEA National and Partner (ILR)

Hello Everyone,

I am a Partner of EEA National. She will complete her 5 Years in UK in July 2017. I have been living in UK since 2011 and with my partner since November 2012. However Home Office gave my EEA Family member RC in August 2015, which is valid till 2020.

Now My partner will apply ILR in July and someone told me that I should apply my ILR with her as I will almost complete 5 years in living relation with her.

Please let me know legally can I get ILR if I would apply with her or Do I have to wait until 2020?

You say 'partner', are you an unmarried partner or are you married? This makes a difference on when you can apply.

Also note, members on the EEA/EU route DO NOT apply for ILR which is the UK immigration rule route. EEA/EU applicants apply for 'confirmation of PR'.
