Divorce petition inUK with Hindu Marriage Certificate.Nyone?

Post by DR2636 » Sun Feb 19, 2017 4:12 am

Hi,

I'm considering to do a divorce petition soon, in UK. My circumstances are as below:

-> We got married in India in April 2005. We registered our Hindu marriage a year later and got a Hindu marriage registration certificate in April 2006.

-> Both of us had been residents (living and working) in the UK from October 2007.

-> I am British citizen (with OCI) and my husband is still an Indian passport holder (ILR)

I would like to know if my marriage would be considered legal/valid by the UK court if I file a divorce petition. I have read that UK law doesn't recognize Hindu Marriage Certificate. Is that correct?
We both live and work in the UK. So, applying for divorce in India is not a feasible solution.

Would really appreciate response from someone whose petition for divorce was accepted by the UK court (with the Hindu Marriage Registration Certificate from India). Or in case if you know anyone who managed to do so. If yes, how?

Kindly help me ASAP. This is super urgent.

Cheers,
Guddi.

You would need to contact the court, there is a general enquiry number and they are quite helpful. If you live in London, divorces' are processed in Suffolk. The link below will provide contact details depending on where you are based. Important to note that it is not a quick process here.

If your marriage cert was recognised as valid for visa purposes, it should be ok for divorce, but suggest phone them to find out.

Your question is not immigration related but family law related.
