ICT Tier2 Long Term Staff after 2011

Hello,

I am working in UK with a ICT Tier2 Long term staff visa from July-2013 and can work till July-2018.
I have an offer to join another company who can sponsor my Tier 2 General visa.
I am ok to quit my current job and serve the notice period etc.

is cool off period of 12 months applicable in this case also, where i change my visa sponsor or is cool off applicable only when people want a switch of visa?

or Can i quit the job here, go to india and apply for Tier2 General Visa from there?

But you are switching visa - Tier 2 ICT to Tier 2 General - they are two different categories.

12 month cooling off applies as far as I am aware.

The link below states only ICT Established Staff can switch without cooling off period.

Hi ,

Thanks for your comments and the link, I have been doing some readings from that site and it does not mention cool off 12 months.

The last eligibility criteria says the below:
You must leave the UK and make your Tier 2 (General) application from abroad if you’re not in any of these categories.-- Looks like since i am not in any categories mentioned in the eligibility criteria - https://www.gov.uk/tier-2-general/switch-to-this-visa

any suggestions?

You should also read the T2 Sponsor guidance in conjunction to this: https://www.gov.uk/government/uploads/s ... 2-2017.pdf

It mentions the details about the cooling off period (section 38.4 onwards). In your case, since you will be required to return and apply from home country, you will be subject to 12 month cool-off period.

Thanks for your comments, I understand the 12 months cool off period is a mandate in my case.
to my surprise, ICT Tier 2 Long term staff - Dependent does not have any such cool off period restrictions.
This was the reason i was slightly confused about it.

That's correct. Dependents are not submit to cool-off period. That's how the rule is.

That would be because dependents are not actually sponsored by the employer but are dependent on YOU.
