Type of application for child born outside UK (Father -ILR)

PBS dependant needing to switch to ILR dependant

Hello everyone

My husband is currently on ILR, but I am still on a Tier 2 Dependant visa, which expires in June 2017.

I will now need to switch to the ILR dependant visa, but am totally confused about which form to use. There seem to be multiple forms for multiple scenarios.

I would appreciate if someone could shed a light on this please.

On what basis did your husband get ILR, 10 years long residence or 5 years PBS route?

There is no visa called 'ILR Dependent'. It is a Spouse Settlement Visa and there is only one form.

Thank you for your response CR001.

My husband got ILR on the basis of 10 years long residence.

The confusion I had was whether to use FLR (M) or FLR (FP) form for spouse settlement. I would be grateful if you could point me in the right direction.

FLR (M) if you/hubby meet the income requirements. A new 5 year route to ILR (2 x 2.5 year visas)

FLR (FP) if you/hubby do not meet the income requirements. 10 year partner route. Also a difficult route if you don't have kids etc.

Hi all

My husband is currently on ILR and I am soon going to apply for spouse settlement with FLR (M). On arrival of visa, I will be travelling to my home country for delivery later this year.

My husband will be eligible for naturalisation after the birth of the child.

My query was, when the child is born, what kind of application would I have to make for him/her?

Is it required to pay a health surcharge for the child?

What are the maintenance/salary requirements for the child's visa?

Same visa as you, child settlement visa.
Is it required to pay a health surcharge for the child?
Yes
What are the maintenance/salary requirements for the child's visa?
Your husband will have to show £22,400pa salary.

If the child is born in the UK, then the child will be British automatically and can apply directly for a passport.

Thanks for your reply.

I had asked for the health surcharge specifically as when I checked on the ukvi website, it showed up as £0 for the child. There seem to be other threads on here as well saying that the health surcharge for dependant's under 16 is £0.

I wanted to confirm if this is correct.
