Question on Exceptional Leave to Remain

Post by tariq22 » Tue Feb 21, 2017 5:12 pm

Hello,

This is my first post, I hope you can help.

A friend of mine was granted Exceptional Leave to Remain some time ago but due to ill advice and stupidity she did not apply for an extension and just left it. Her leave has expired 5 years ago now and I have told her she needs to do something about it because as far as i know she has overstayed her visa (is that right) and if found out she will be deported. She is from Iraq (i dont want to give specifics but from an area on the frontline of the Daesh war). I think its very serious and worried for her. Can anyone advise me of what to tell her to do?

Tariq

Which one of the three possible visas was she given?
a) Discretionary Leave to Remain (typically given for three years)
b) Asylum
c) Leave Outside The Rules

And, as CR001 asked, what was the basis for the grant?
I am not a lawyer or immigration advisor. My statements/comments do not constitute legal advice. E&OE. Please do not PM me for advice.

Thanks for the replies. From memory I know that she was given permission to stay for 5 years because iraq was not a safe place for her to go back to.
