EEA(PR) in Appeal. Non-EEA(37Y)&Dutch Dad(70Y) + 10 Year ILR

Post by akhr90 » Thu Feb 23, 2017 10:35 am

Hi All,

My Case history:

Came to UK: JUNE 2004 as Student
Until Jan 2011: I had 5 student visa extension no complication straight forward extension.
EEA 2 : Applied for 5 Year EEA Resident card, I am 37 Years & Dad 65 years at that time (As a Direct family member)
Visa Refused : April 2011
Appealed in 14 days.
Appeal allow in June 2011.
Got 5 Year visa in July 2011.

My 10 year were completed in June 2014 but didn't apply for 10 (LR) because of personal reasons.

Applied for EEA PR in June 2016.
Refused: Jan 2017. (Base was I was earning upto 35K from work, case worker stated how come you are dependent, my other post is this one ( http://www.immigrationboards.com/eea-ro ... 10404.html )
Appealed: Within 14 days.

Q: If I apply for 10 year (LR) are they going to ask me any question relating to EEA PR? And which documents should I send now?

Please advise regarding this, as even after spending 12 legally I am still no where?

Thanks.

If you apply for ILR based on 10 years long residence which includes time as an EEA FM, you must submit ALL the documents to prove that your EU sponsor was exercising treaty rights for the whole period that you have been an EEA FM.

Hello CROO1

Thank you for the advise, much appreciated.

Yes he is exercising treaty rights and will definitely send all the documents. When my visa was refused they didn't question regarding this treaty right. They are all in order.

Q: Is HO going to check or involve EEA PR decision in this category?

Q: Should I go for postal application or premium?

Please advise regarding this.
