Naturalisation - date of the application - must send today

Post by seraax » Fri Mar 03, 2017 9:06 am

Hello Experts,

I missed the post office collection yesterday due to work and if I understood correctly, my application must be deliovered by the 4th of March the latest.

Here is the situation:

I am married to a BC, for 5+ years (since 07/2011), but had my PR card since 01/2017.

I am worrying about being absent from the UK 3 years from "the date of the application", as I went to visit my family on 04/03/2014 and came back beginning of April.

So my question is, if I send it today with RM special deliver service, will it be delivered tomorrow or there will be no one in the HO on Saturday to accept post, so they would receive it only on Monday the 6th, when I would be absent 3 years ago and I will get rejected because of that?

I appreciate if some one could help urgently, I live in London, but thinking to drive to Liverpool to deliver my application today personally.

Option 2:
I am thinking about to cover 5 years period in the “absences section”, as 5 years ago from today I was in the UK. Will this work, or it must be 3 years as I am married to a BC?

I will appreciate any help and advice.

Best regards,

S

Likely that the 'date of application' will only be on Monday and yes, it will be refused as you were not physically present 3 years ago.

You cannot deliver your application 'in person'.

You can apply on the basis of 5 years, but HO might process it on the basis of 3 years.

Why are you cutting it so fine? Why not just apply in the beginning of April.

Thanks for the help.

I am trying to avoid new fees. Another thing is, it will be a new financial year and I have to deal with my taxes as I am "self employed", so it will delay everything even more I think.

Do you think I can include some sort of letter asking them to consider my application based on 5 years? Will I be eligible if I had my PR card only since January?

Best regards,

When you say PR, do you mean ILR??? They are two different routes.

My understanding is that if you apply on the basis of 5 years residence, you need to hold ILR for 12 months.

It is only the spouse of BC route that does not require that.

There has been no indication as yet of when/if fees are going up.

On what date, 3 years ago, in April did you arrive back in the UK?

I meant Permanent Residence card, which used to be called ILR I think.

Looks like the fees are going up on 18th of March.

Yes, I think they would want me to hold it for 12 months if it's based on 5 years route, so I'm not sure if it will work out well for me.

I came back on 05/04/2014

What do you think would be my options?

I meant Permanent Residence card, which used to be called ILR I think. No, you are mistaken. PR is for those on the EEA/EU route. ILR is for those on the UK immigration route, i.e a spouse visa, work permit etc.

Looks like the fees are going up on 18th of March. This is from last year. There has been no announcement on fees yet for this year.

I came back on 05/04/2014 If you arrived back in the UK on this date 3 years ago, then this is the date you can apply. Fees usually go up on 6th April (except last year). If you apply through NCS at the council on 5th April, then that is your application date and the current fees should be relevant.

What do you think would be my options?

Thank you

Thank you so much for the advice.

Just to make sure, if I send it by RM special delivery service on the 4th and they would receive it on the 5th when I returned to the UK 3 years ago, I would be eligible, wouldn't I?

Date of application by HO is the date of receipt +1 day.

I strongly suggest you apply using NCS as you then also get to keep hold of ALL your original documents and passports. For NCS, the date of application is the date of your appointment.
