Appeal is taking much longer than stated

Post by ryanoleary1994 » Fri Mar 03, 2017 8:05 pm

I am a British citizen and I am married to a Canadian citizen, who had lived here for two years on a tier 5 youth mobility visa. She is a teacher and we have currently been separated for combined total of 11 months now. We are currently undergoing an appeal for a right to remain with family, but it is suggested that these are backlogged and delayed currently. Like many other on these boards would know, it is incredibly difficult to be apart, and having to travel regularly to Canada. The appeal is currently 26 weeks in, waiting for the hearing date. The original application I believe should have been accepted has I had the required savings in combination with my earnings, which is frustrating! Just looking for advice on next steps really and any other possible avenues we can take.

Yes, appeals are taking in some cases more than a year.

Quicker to reapply.

What were your earning and what level of savings did you show?

Exact words of refusal (minus personal details)?
