From Tier 2 (General) to ILR

Hi there,
I have a quick Question if you can able to help with the information.

I will be switching to different company in April 2017 and eligible for ILR in May 2017. So I will be going to show 3 payslips ( April payslip from new company and last two payslips from old company) when I go for ILR and P60 from Old company. Do I get any problem when I go for ILR ? Please let me know

You only need one payslip which must meet the salary requirement for ILR.

Seems a waste to pay for two applications in such a short space of time. Can't you stick with your current employer till you get ILR?

Thank you so much for your reply. Old company sponsorship licence suspended so can't stay with that company no longer that is the reason I will be switching to new company.

I have been told by sponsor yesterday but I have not received any letter from Home office.
As they were saying that there was an issue in one of the project that is the reason licence suspended this what I have been told.

An issue with a 'project' doesn't sound like the reason. Your sponsor either complied with ALL the requirements of a sponsor or they did not.

In terms of ILR, how likely do you think a new sponsor will issue you the required 'foreseeable future......' letter which is mandatory for ILR if you have only been with them for 1 month, when they know very well that you can leave once you have ILR?

I did explain everything to them and happy to sponsor me and happy to give the letter as well that is required for ILR.

I was bit worrying that payslips on different companies (latest payslip under new sponsor and rest of the two old sponsor ). Can you please let me know

It is your choice to change sponsors. If you want to submit the 3 payslips then it should be fine but your most recent payslip MUST meet the £35,000 and that this is not substantially more than previous months pay with your previous employer.

Thanks for your information. Looks like I don''t have any other option only I can see is switch to new sponsor. do you think is there any other option without going for another tier 2(general) extension ?
With my previous employer I am on £35,100 as I get P60 for April 2016 to March 2017.


that this is not substantially more than previous months pay with your previous employer.

sorry I didn't get your above point. Is that mean do they need to run same salary under new sponsor (£35,100)?

When migrants have a sudden sharp salary increase just before ILR, i.e. £23,000 to £35,000, it immediately raises red flags with HO.

On what date do you qualify for ILR?

What date was your initial visa granted and what date did you enter the UK?

If you are applying to switch in April, are you aware of the immigration skills surcharge your new sponsor will have to apply for applications from April onwards?

My first Tier 2 (general) visa date of issues is 2nd of May 2012 and 5 years will complete on 1st of May 2017.

as per 28 days rule I thought to go for ILR on 8th of April 2017 but circumstances has changed now :(

I came as a student on 28th of January 2009 to UK and I did masters and moved to PSW then to Tier 2(general)

As you suggested I will ask my new sponsor to maintain same pay (£35,100) or else I ask them to run £36,000.

Your new sponsor can pay you more if they wish to, but must be a minimum of £35000

thanks for your reply.

As I said earlier my limited company licence suspended last week but we haven not received any letter from HO ( I guess will take 2 to 3 months to receive letter) so One of my friend suggested that I can go for ILR (which is in April) because we haven't received any letter from HO yet and also put a letter saying that you are in Holiday in March month.

Can we trust his suggestions please let me know

Some points to consider

While a Sponsor is suspended any associated activity with the licence is suspended or placed on hold. In you case if you apply for ILR while the Sponsor is suspended your application will be placed on hold pending the outcome of the further investigation of the Sponsor. If the Sponsor is revoked your ILR application is refused. If they regain their licence your ILR will progress.

The nonsense idea of applying earlier due to holiday will not work on so many levels.

If your Sponsor was suspended on the basis of non genuine vacancy that also clouds your ILR application as it is perceived you have gained from a role that did not meet Sponsor Duties.

Your salary/salary range must have been clearly mentioned in the job advert (RLMT requirement), so hope it's not a random salary that you are able to negotiate as per your ILR needs.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

I think the extension applies only if you're with the same employer and on same job/soc code.

If you change employer, then you are applying for a fresh Tier 2 visa (inside UK) that needs to meet RLMT requirements, etc. So you may be using wrong application link i guess (?).

Did you search the forum as this is quite common scenario n there should be a step by step guide i wud imagine
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Yes you have to apply to extend your visa.

Switching is for switching into T2G from another category.
