ILR 180 days rule enquiry

Post by sachin1683 » Sat Mar 04, 2017 8:45 pm

Hi Team

I have a question related to continuous 5 years of eligibility for ILR. My wife hold Tier 2 General visa and I am on Dependent visa. Currently she is on Maternity leave and outside UK.
Our Visa is valid from 09-Apr-2015 and we entered on 08-May-2015. Below are our consecutive periods (assuming we made ILR application on 9-Apr-2020).

Currently she is on Maternity leave from 28-Nov-2016 till 01-Sep-2017 = 277 days. But it didn't exceed 180 days in below consecutive periods.

Year 1 : 10-Apr-20 to 09-Apr-19
Year 2 : 10-Apr-19 to 09-Apr-18
Year 3 : 10-Apr-18 to 09-Apr-17 :: 144 days
Year 4 : 10-Apr-17 to 09-Apr-16 :: 132 days
Year 5 : 10-Apr-16 to 09-Apr-15 :: 31 days

My question is whether she can take leave till 1st Sep 2017 in such scenario without losing the continuous period??

Thanks.
