Hai All,
All we need to know from someone is can we apply for ILR when the company is suspended.
Called the UKBA Cardiff PEO and they said it shouldn't be any issue if the company is suspended
This suspension should not effect your ILR application unless it is revoked
We are looking to team up and meet an immigration solicitor to take an advice on this.
Meantime can anyone in this forum help us with some inputs.
Particularly waiting for responses from moderators like sushdmehta

Of course the suspension affects ILR application. Your ILR application will simply be put on hold. See FrontierMole's post in the link below.

The rules state that your Sponsor must be able and willing to continue to employ you in the same role for the foreseeable future.
If the role you are in is suspect and considered a non genuine vacancy this will place your application on hold. If your Sponsor loses their licence they are unable to continue to offer you employment therefore are unable to continue to employ you for the foreseeable future. Therefore you ILR application will fall for refusal.

Hi Vivek,
Did you able to get the ILR when your sponsored company licence was in suspension state. Can you throw more lights on the same.
Is it possible to get the IL when the sponsored company licence is suspended or revoked?
Thanks.

The user has not returned to update since the last posts in December 2017.

You cannot get ILR if the licence is suspended or revoked.
Kindly start your own topic with your circumstances rather than tagging onto another members thread. Thank you.
