Help and Guidance needed, what to do in current situation?

hi,
I want to ask, If a person married in back home, Can he apply asylum in the UK as same sex partner with British national?
what are the chances to get approved the asylum. and what documents are required?
any help and guidance will be highly appreciated.

What country will this person be claiming asylum from?

Is the British citizens the same sex spouse?

How will this person enter the UK?

Why not simply apply for a spouse visa and do it properly?

I am sorry, I could not explain my question properly.

I want to ask, If a person is married in back home (India) and 4 years ago he applied for visit visa for his wife and kids when the person was on student visa in the UK. and his family (wife and kids) visit visa was refused. from then the person is still in the UK and waiting for the final dismissal of appeal from the court for EEA extended family member. Now that person , Can he apply for asylum in the UK on the basis of Gay. his same sex partner is British. is it possible to do?

Why possible reason will he used as his reason to apply for asylum?

EEA Extended family member application is NOT the correct form for a partner of a British citizen.

Is the person still married to his wife? HO will have a record of this fact?

An asylum claim for being gay, a very popular route for asylum claim currently.
I am assuming you are still married to your wife?
Overstayer (?) and a failed attempt at an EEA extended member application.
The asylum claim will almost certainly be refused for a variety of reasons.

Your immigration history is very much against you and unless you can somehow convince an immigration judge that India as your home country is not a tenable country for homosexuals then you are on a route to no where.

Thanks for understanding my point. It means it is not good to do asylum on that basis? is there any other way to legalize myself in this country or get back to the track for applying a Visa?

hi,
I am currently in the UK, My Immigration Status is under Question, as Extended family member appeal is no longer valid. I want to know if I can do the following?
My wife and kids are India. I want to apply for Employment permit for my wife and how can she bring the kids with her, and if I can join her in Ireland as her dependent?
need help on How to register a company in Ireland for her as a Non EU resident Director of the company?
how to open the Bank account for her in Ireland? and what other things will be required to get the employment permit for her?
waiting for the advise and help

You will have to go back home to apply for a visa to Ireland. You cannot apply for this in the UK. Your wife likely needs a sponsor in Ireland to get a work permit.

You should also note that the UK and Ireland share immigration data. There is no easy way that you can regulate your stay without returning home to apply for a visa.
