Extension of depdendent visa if the main applicant gets ILR

Post by pall » Tue Mar 07, 2017 7:42 pm

Hello,

I am currently on Tier 2 general visa. My visa start date was April 2015 and expiry date is April 2020. My husband is currently my dependent. He applied for dependent visa 6 months later, which means his dependent visa start date was Oct 2015 and expiry date is April 2020.

I will complete 5 years in April 2020 and will be eligible for ILR. My question is -

1. Once I get ILR, my husband will still need to complete 6 months before he can apply for ILR. Can he extend his dependent visa if I am on ILR. If yes, which visa type?

2. How many days in advance can I apply for ILR, before I complete 5 years?

3. If my husband switches from dependent to tier 2 main, will the time he spent on dependent visa be reset or will it count towards 5 year period?

Yes, Tier 2 General Dependent visa. It will be a 3 year extension even if he only needs 6 months. He will also have to pay the immigration health surcharge.

2. How many days in advance can I apply for ILR, before I complete 5 years? Within 28 days of meeting the requirement.

3. If my husband switches from dependent to tier 2 main, will the time he spent on dependent visa be reset or will it count towards 5 year period? No, it will be reset to zero.
