Hello

Q: Tier 1 E (200K), does hiring an employee holding "refugee status" count toward points? The employee doesn't hold ILR (they haven't reached the 5 years requirement yet)

Two quick notes:
1.
Tier 1 Document on the criteria for approving job creation:

Settled in the UK within the meaning of the Immigration Act 1971, as amended by the
Immigration and Asylum Act 1999, and the Nationality, Immigration and Asylum Act
2002.


2.
gov.uk on How someone who holds Refugee Status could apply for SETTLEMENT

Settlement: refugee or humanitarian protection
One can apply to settle in the UK (known as ‘indefinite leave to remain’) if you’ve got a residence card as a refugee after 5 years in the UK.




My take at the moment is, so long as ILR (here maybe settlement) has not been granted to a person holding Refugee Status, such an employment wouldn't count toward acquiring point in Tier 1 E route.


Could someone please help to clarify the situation? If there is any evidences based on any extension application approval/refusal, it would be much appreciated.

Unless they already have ILR, they are not settled and it cannot be used to claim points.
