residence requirement

Post by onionw123 » Sun Mar 12, 2017 11:56 am

Hi,

I am apply citizenship for myself and my daughter under section 3(1). I wonder if my daughter need to meet residence requirement?

e.g. "physically present in the UK 5 years before the date that the application will be received by the Home Office" and "you must not have been absent for more than 90 days in the last 12 months. And the total number of day’s absence for the whole 5 year period should not exceed 450?

Registration at the Home Secretary’s discretion – Section 3(1)
application
Children born abroad to parents who are applying for British citizenship
Where one or both parents are applying for British citizenship they may apply for one
or more children who are not automatically British at birth (see “Automatic acquisition
of British citizenship” above) to be registered as British citizens as part of a “family
application”. Children in this category will be considered at the Home Secretary’s
discretion and will usually be registered only if both the parents are granted or already
hold British citizenship, or if one parent holds British citizenship and the other is
settled in the UK.

No, they do not. Older children are however expected to be resident for at least 2 years (teenagers)

How old is your daughter? What is the immigration status of the other parent?

Children over the age of 13 are expected to have been resident in the UK for at least two years.

She is 3 years old now, and she has got ILR since 07/2015

Both me and my wife have got ILR. and I will apply citizenship with my daughter together, but my wife won't

Fine for your daughter to apply at the same time as you.
