Hi all,

I had applied for tier 2 general extension but my application on hold. Home office asked additional information from my employer. All information has been submitted and I am waiting for my visa since last few months.

My wife is my dependant. She works as a full time employee in a a rated sponsor licensed company. Can anyone please help me with the questions below.

1. If our extension gets refused then we will apply for review. If it gets refused in review too then v have to go bcak to our country. Can my wife apply as tier 2 main applicant if her company sponsor her?
2. Does she needs to give English exam? She has done post graduation degree in the relevant field by English medium. How can we check if the Indian degrees are recognised by uk naric?
3. How much chances are there tht she will get the visa and then I can be her dependant?
4. If our visa gets extended now, then can she switch from my dependant to become main applicant? I don't want to take risk with future ILR . Rules are getting strict.
5. Shall I continue with my sponsor only if gets an extension?

What could be the best option? Please guide

Yes she can, provided the full and proper RLMT is done to prove she is not 'pre-selected' for the job.

Contact NARIC and pay for the assessment.
3. How much chances are there tht she will get the visa and then I can be her dependant?
Depends if she/sponsor meet the requirements. If she gets a visa, then you can apply as dependent or apply at the same time as she does.
4. If our visa gets extended now, then can she switch from my dependant to become main applicant? I don't want to take risk with future ILR . Rules are getting strict.
Yes, this will reset her clock to zero though.
5. Shall I continue with my sponsor only if gets an extension?
Your choice and decision.

9. If extension gets refused we will get 14 days to apply for review. Can v apply fresh application as my wife main applicant within that time. I can stay in uk. If she gets visa she can come to uk and I can join her here only AND MY CLOCK WILL NOT BE ZERO....????Do I need to go back with her to our country?

No she does not have to resign but expect a high level of scrutiny on the RLMT regardless, even if she does resign.
7. How her company can make sure she is not preselected. Advertise job add on two websites for 28 days?
The company also must not make the advert for the job so restrictive that it favours your wife and excludes all other applicants.

Yes, you can reapply at any time. If you have a valid visa and remain in the UK, you can switch to Tier 2 Dependent visa WITHIN the UK. Both of your clocks will be reset to zero and you will both need a new 5 years period before qualifying for ILR.

Some people talk about cooling off period but I don't understand what it is and it will be applicable to us if visa gets extended and she apply to be main applicant or visa gets refused and then she applies to be main applicant. In both the situations will there be any cooling off period for us?

Yes, she can apply at any time. There is NO cooling off period for a PBS Dependent applying as the main Tier 2 General applicant and neither is there a cooling off period if you switch from main applicant to PBS Dependent.
Some people talk about cooling off period but I don't understand what it is and it will be applicable to us if visa gets extended and she apply to be main applicant or visa gets refused and then she applies to be main applicant. In both the situations will there be any cooling off period for us?
Stop listening to 'people' who don't know what they are talking about. Cooling off period is ONLY applicable if YOU as the main tier 2 general applicant apply for a Tier 2 General visa as the main applicant again from OUTSIDE the UK.

Hi Char,

My wife got to know that her company does not have enough cos available yet but her boss has already applied for some extra/new cos letters or will apply soon. Can u plz tell me how much time it takes to get the new cos available to be used? In case if visa gets refused and she asks her boss to sponsor her then his boss might have to apply for new cos (if not already applied). She is doing great in her job and also got best employee award last year and her boss does not want her to leave the company.

12. My wife already working in A rated sponsor company. And earning £26,000. If she goes back to our country to apply as a main tier 2 applicant then how much salary she should have ?

13. Will she be a new entrant tier 2 and show £20,000 around salary or experienced person with background of tier 2 dependant with high salary of £25,000 or £30,000.
I have checked that new salary criteria has come up.
What should be her salary as a main applicant now for same job and same sponsor or different sponsor?

14. Is it good to withdraw it extension application now and my wife can apply as main applicant or we should wait for the decision and then apply in any case extension granted/refused. Don't want to take risk with future.

15. If withdraw extension now can they ask my wife during tier 2 main application in our country why we withdraw etc?

16. I have applied to UK naric for degree check. Is it sufficient enough if her degrees are recognised by uk naric and degrees taught in English language with all proofs?

17. Or she should sit for English exam? If yes then which one , IELTS Or SELT? Is it Ielts general training exam ? Can she give it in uk or our country? What is the exam name for tier 2 general work?

18. Which is more relevant ielts exam or her own degrees taught in English and recognised and verified by uk
Naric? Or can she submit naric proof and give ielts exam both.
