tier1 (general) dependent to flr(m) towards ILR

Hi,

I invited my wife to the UK on Tier1 (General) dependent visa but during this time i obtained ILR via 10 year long residence route. After this time we extended her visa under FLR(M) (Family of a settled person).

I would like to know if her time spent under Tier1(General) dependant count towards the ILR?

Any help will be much appreciated.

When did you get ILR?

When did she APPLY for FLR(M)?

When did she ENTER the UK on Tier 1 G Dep visa?

Hi,

My wife entered UK in April 2014 (as Tier1 general dependent) and i got my ILR (as 10 year long residence) in Oct 2015.

She then got an extension to stay in the UK under FLR (M) in April 2016 and she is due for a visa extension in Dec 2018.

As you were granted ILR under long residence your wife's immigration clock would have been re-set when she switched to FLR(M), putting her on a new 5 year path to ILR.

Time as Tier 1 Dependent and FLR(M) would only have been possible if she had applied for FLR(M) before April 2014, which is when the rules changed and the transitional provisions were removed. Clearly she doesn't fall in this category anyway as you only got ILR LR in Oct 2015.

As Casa has said, she now needs 5 years on FLR(M) before she will qualify for ILR.
