Application type (FLR(FP)): Postal Application
Application Submitted on : 29th of May, 2016
Decision of Application : Refusal with Right to Appeal
Date of Decision : 23rd of December, 2016
Date of Applying for reconsideration: 28th of December, 2016

Present date: 27th of March 2017 (No good news from HO yet)


We think the reason for refusal by HO was: As myself and my wife were not not married at the time of applying for FLR FP and hence we did not stand a better chance. But for now we both are married and possess a good relationship. Now as we are married and satisfy all of the set standards of income and a substantial relationship we applied again to reconsider the case as our circumstances have changed to Husband and Wife and soon to be parents we hope to hear some good news. Although there are no sign of that, but a hope is still there. It has been a tremendous amount of pressure on both of us during this journey in which we benefited with loads of bad news from HO i.e. refusal and no right to work.

Any suggestions would be appreciated.

FLR(FP) partner route may stand a better chance once your baby is born.

Much depends on whether the HO decide that you can re-settle together outside of the UK.

It would help if you posted further background to your immigration history.

You will stand a better chance once your baby arrives, I am in the same situation as you, except that I was already married at the time we made our first application. HO have said no because they think there is no insurmountable obstacle even though we stated a few. But I think once your baby arrive that would help

I came here as a student on Tier 4 visa. I met my other half in a club and after several meetings we decided to live together. After understanding each other we decided we are comfortable together and a right choice for each other we spent few months(I think 6) together we decided to apply for FLR FP(as suggested by our lawyer). On 16th of December we decided to choose our special day. We applied on 29th of May 2016 and did our bio metrics within few days after getting the letter and it took like nearly seven months for HO to say NO (before two days of Christmas). We applied for reconsidering the case again on 28th of December, but have not yet received any response from HO yet. While we have contacted or local MP for same as well.

What date did you come to the UK on your Tier 4 visa?

What date did the Tier 4 visa expire?

What date did you meet your partner?

What date did you move in together?

What do you mean by this below? Did you get married and if yes, how did you get married?

If he was a good lawyer, he must have known the FLR (FP) will fail.

I believe you have overstayed at present, therefore it is likely to fail. There will be a slightly better prospect once the baby is born.

How did you get married??

So you lived together for roughly 4 months before submitting an FLR(FP) application 3 days before your Tier 4 visa expired?

We got a letter from HO saying you need to apply within 7 days or have to leave this country and we applied within 3 days after receiving the letter. Have I overstayed then? Does that make me illegal?

Yes exactly and we got married in Registrar Office in the presence of family members and friends.

That isn't how it works. You are required to give 28 days notice of your intent to marry. You need your passport and valid visa. The HO approved Registry then has to notify HO and this notice period can be extended to 70 days for HO to investigate/interview etc before granting permission to marry.

Sorry forgot to say we did that before itself. We asked HO to give our passport stating the reason for getting married to which in return they gave us certified copy of my passport and visa and original of my wife's.

If 2016, then you had no valid visa.

Our lawyer along with a personal letter from us sent a letter to HO giving reason that Applicant and his partner are willing to marry each other and HO sent them bck to the lawyer.

Also does anyone else think I am a over stayer or committing any crime as we have already appealed for our case and it depends on HO when they will give us date for Court Hearing or simply reconsider the case due to our exceptional circumstances which includes authorities like Socials and Police in it.
In brief my wife's ex partner was and is still a threat to her child and hence we both have played a significant role to help Police regarding him.Socials and Police are helping us and have already wrote letters regarding this to the HO to compel them for reconsidering the case .
